Bank Debt Collection

A successful lawsuit may grant a creditor a judgment, but it isn’t the end of the collection story. Judgment recovery can often be as challenging as attempting to coerce the debtor into paying off the debt voluntarily. While a judgment recovery specialist may help a creditor collect the overdue debt it is owed, continuing to use court enforcement is cheaper and often just as effective.

Collecting a Debt Through Garnishment

In almost all states, judgment creditors have the right to collect a debt through wage garnishment. This process requires the creditor to request a certified copy of the original court judgment. Certified copies may take a week or longer to be processed by the court.

Once the creditor has the certified copy of the court judgment, it can bring the document to the county clerk’s office and request a writ of garnishment. Skip tracing may be necessary in some situations since the creditor must be able to supply the court with information about where the debtor works.
